US Court Mandates Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment lacks lawful basis.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The case originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to answer human smuggling charges, he was detained in immigration detention.
In her order, the judge noted that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The legal proceedings involve conflicting claims. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.
